1. Wilbanks Partners llc takes the privacy and security of your information seriously. This Policy describes Wilbanks Partners llc’s collection, use, transfer, and disclosure of your information. This Policy covers information Wilbanks Partners llc collects in connection with our Recruitment Services, Consulting Services, and Products (collectively, the “Services”). This Policy also covers information collected through:

1.1.3. our social media pages and apps to which the Site links (collectively, our “Social Media Pages”), and

1.2. This Policy also covers other means by which we collect information. For example, it also covers how we collect information from in-person discussions, telephone conversations, and through non-electronic communications (i.e., collection through other means than our Online Systems).

2.1.  Collection of Personal Information. In connection with our Services, we collect name, contact, and employment details, as well as other Personal Information as may be deemed necessary.

3.  WHO WE ARE

3.1.  Wilbanks Partners llc is an executive recruiting and organizational consulting firm. We help companies design their organization – the structure, the roles and responsibilities, as well as how they compensate, develop, and motivate their people. We also help organizations select and hire the talent they need to execute their strategy.

3.2.  Wilbanks Partners llc offers services to help companies recruit new personnel and attract talent (“Recruitment Services”). We provide Recruitment Services to clients searching for talent at the board-level, chief executive, and other senior executive positions. We also help clients find talent for middle to upper level management. Our teams also provide recruitment process outsourcing or project recruitment services to help clients attract top people. We help our clients implement their business strategy by consulting with them on strategy execution and organization design, talent strategy and work design, rewards and benefits, assessment and succession, leadership development, and other talent needs.

3.3.   Wilbanks Partners llc also has products that may be used by you or our clients to conduct assessments, participate in surveys and career coaching, conduct compensation and benefits analysis (where permitted by law), and facilitate the recruitment process (“Products”).

4.  PERSONAL INFORMATION WE COLLECT

4.1.  We collect various categories of Personal Information in connection with the Services.

4.2.  If you submit an inquiry or question via an online form or email to our website, we collect your name, email address, or other Personal Information contained in your correspondence, including information shared in a résumé or CV.

4.3.  If you receive or participate in our executive, board search, or leadership consulting services, we collect your name, title, professional and personal contact information, demographic data, results of any assessment, survey, or questionnaire you complete, compensation[B1] , employment objectives, memberships, community involvement, details in your curriculum vitae (including your educational background, work history, and other qualifications), language skills, job performance, reputation, responses to interview questions, and financial details (to coordinate and reimburse for travel), which we collect from you or third party sources such as online searches, professional contacts, and your employer (only for our leadership consulting services).

4.4.  If you are a client or potential client, we collect your name, contact details, title or position, products or services requested, or other information that you provide including via online forms or email correspondence.

4.5.  Unless required or authorized by law, we do not process sensitive Personal Information about you unless you have affirmatively consented to this processing.

5.  CANDIDATE DATA

5.1.  Information Candidates provide to us: If you are a Candidate, you may provide personal information to us, for example, email your résumé to a Wilbanks Partners llc search consultant, speak with a Wilbanks Partners llc search consultant, or communicate with us in any way in connection with the Services. Furthermore, as described below, we may obtain information about you from other sources.

5.2.   You are not obligated to provide Wilbanks Partners llc any information or participate in any of the Services we offer. As such, we will consider any information we collect directly from you as having been provided voluntarily. If, however, you are unwilling to provide us with certain requested information, please understand that this may limit our ability to consider you in connection with the Services.

5.3.   Your Candidate Information Processed by Wilbanks Partners llc might contain:

5.3.1. your contact details (name, address, phone number, email address, etc.),

5.3.2. your biographical data,

5.3.3. information on your professional education,

5.3.4. your educational credentials, professional diplomas and certificates,

5.3.5. your employment and compensation history, data on your suitability for client opportunities we compile as part of our assessments of your professional profile,

5.3.6. information on your personal and professional life publicly available via social media services (e.g. Facebook, Google, LinkedIn, Twitter, etc.) or otherwise on the Internet that might be of importance to your qualification for a particular executive or similar management position, and

5.3.7. any Sensitive Personal Information you might choose to disclose to us.

5.4.  Information we collect from third party sources about Candidates: We may collect any of the above personal information about you from publicly available sources, and third parties, including, under the following circumstances:

5.4.1. Sources and Referees may disclose personal information about you;

5.4.2. our Clients may share personal information about you;

5.4.3. we may obtain information about you from publicly available third-party sources (e.g., LinkedIn, news reports, press releases); and

5.4.4. we may source personal information about you from our third-party data providers (e.g., BoardEx, Bloomberg) and degree verification/background check providers (e.g., Mintz Group). When we obtain information about you from third party providers or vendors, we take appropriate steps to ensure that such third parties are legally permitted or required to disclose such information to us.

5.5. Information Clients provide to us: Our Clients may provide us with personal information about certain Candidates in connection with our Services (for example, they may provide us with a list of Candidates they would like us to assess through the Services). We typically process this personal information as a processor on our Client’s behalf. We use that information to provide the Services to our Client and as instructed by our Client. Under these circumstances, it is our Client, as the controller, that controls what personal information about you we collect and how we use it. If you have privacy-related questions or concerns about a Client’s privacy practices or the choices a Client has made to share your information with us or any other third party, you should reach out to the Client or review their privacy policies. We are not responsible for the privacy or security practices of our Clients, which may differ from those set forth in this Notice.

5.6.   Your Candidate Information will be shared with third parties as follows:

5.6.1. Via our databases, your Candidate Information will be available to the consultants and administrative staff of Wilbanks Partners llc for the purposes of providing the Client Services;

5.6.2. Subject to our discretion, we might disclose excerpts of your Candidate Information such as your professional education and employment history with particular clients in order to confirm whether they might be interested in you as a Candidate with respect to an opening for an executive or similar management position of which they have informed us. The information disclosed will be limited to what is necessary for this purpose. We will not disclose the entirety of your Candidate Information or otherwise introduce you to any client in detail without first obtaining separate and specific consent from you.

5.6.3. As part of the Client Services, your Candidate Information may be Processed for the purposes of

5.6.3.1. executing searches for potential Candidates on behalf of clients that have an opening for an executive or similar management position,

5.6.3.2. assessing your suitability for client opportunities,

5.6.3.3. informing you of open executive or similar management positions potentially suitable for you,

5.6.3.4. introducing you to clients as a Candidate and potential future member of their management, and

5.6.3.5. verifying your educational credentials, professional diplomas, and certificates,

5.6.3.6. performing searches for information on your personal and professional life publicly available via social media services (e.g. Facebook, Google, LinkedIn, Twitter, etc.), on the Internet or within data you have previously disclosed to us, provided that such information might be of importance to your qualification for a particular executive or similar management position,

5.6.3.7. providing integration services on behalf of a client you have been placed with by monitoring your integration with the client, speaking with all parties involved, and lending support for you to reach full effectiveness in your new role as soon as possible,

5.6.3.8. approaching you, after you have been placed with a client, as a client contact for the placement of other Candidates or as a source of information about potential Candidates for third-party clients,

5.6.3.9. ensuring that, after your placement with a client, you will not be recruited on behalf of another client unless you request consideration for other opportunities, and

5.6.3.10. of operating the databases your Candidate Information is stored in.

5.6.4. We may share your information with any competent law enforcement body, regulatory or government agency, court, or other third party where we believe disclosure is necessary as a matter of applicable law or regulation; to exercise, establish, or defend our legal rights; or to protect your vital interests or those of any other person.

5.6.5. In the case of Candidates, Referees, and Sources, we may share your information with Clients who will need to process your information for the purposes we have described in this Notice.

5.6.6. In the case of Candidates, we may share your information with third parties who we have retained to provide services such degree and/or license verification checks, to the extent that these checks are appropriate and in accordance local laws.

5.6.7. Similarly, for Candidates we may share your information with Sources and Referees with whom we liaise in connection with providing the Services to our Clients.

5.6.8. For Sources and Referees, we endeavor to keep your information confidential from the Candidates you discuss with us, but under limited circumstances, your information may be disclosed to them.

5.6.9.  We may share your information with third party service providers (our Vendors) who perform functions on our behalf (including external consultants, business associates, and professional advisers, such as lawyers, auditors, accountants, technical support providers, and third-party travel agencies, outsourced IT and document storage providers).

5.6.10. We may share your information with a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger, or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Notice.

5.6.11. We may share your information with our marketing partners to send emails on our behalf.

5.6.12. At no point will your Candidate Information be matched, linked, or otherwise connected with Personal Information collected through other components of the Site for purposes other than providing Client Services. Your Candidate Data will be Processed until you revoke your declaration of consent given when sharing Candidate Data with us. Upon the revocation of your declaration of consent, we will delete your Candidate Data from all databases, to the extent allowable by law.

5.6.13. Please be assured that we do not sell your information to third parties or use the information for purposes that are incompatible with those set forth in this Notice.

5.7.  Your Data Protection Rights. You have the following data protection rights:

5.8.  If you wish to access, correct, update, or request deletion of your personal information, you can do so at any time by contacting us using the contact details provided under the Section headed “QUESTIONS” below. When asked to remove a record from our database, Wilbanks Partners llc will retain minimal personal information in order to prevent future contact, to keep a record of the information disclosed to our Clients and Candidates, and to preserve Wilbanks Partners llc’s interests in accordance with any applicable legal requirements.

5.9.  In addition, if you are a resident of the European Economic Area, you can object to processing of your personal information, ask us to restrict processing of your personal information, or request portability of your personal information. Again, you can exercise these rights by contacting us using the contact details provided under the Section headed “QUESTIONS” below.

5.10. You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you. To opt-out of other forms of marketing (such as postal marketing or telemarketing), please contact us using the contact details provided under the Section headed “QUESTIONS” below.

5.11. Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. If you withdraw your consent to our Notice, you will not be able to be a part of a Wilbanks Partners llc’s search, assessment, or leadership project.

6.  CLIENT DATA.

6.1.  Information Clients provide to us:

6.1.1. We need to collect and use information about you or individuals at your organization in the course of providing the Services to you.

6.1.2. We generally only need to have your contact details or the details of individual contact(s) at your organization (such as name, telephone number, email address, and job title) to ensure that our relationship runs smoothly.

6.1.3. We hold information relating to your online engagement with Candidate profiles through our Client applications and will keep a record of our contact with you.

6.1.4. We may hold extra information about you that someone in your organization has chosen to tell us.

6.2. Information we collect from third-party sources about Clients:

6.2.1. Where appropriate and in accordance with local laws and requirements, we may seek more information about you or your colleagues from other sources generally by way of due diligence or other market intelligence including:

6.2.1.1. from third-party market research and by analyzing online and offline media (which we may do ourselves or employ other organizations to do for us);

6.2.1.2. from attendee lists at relevant events; and/or

6.2.1.3. from other limited sources and third parties.

7.  REFEREE DATA

7.1.  Information Referees provide to us:

7.1.1. In securing a reference from you about one of our Candidates, we may process your contact details (such as name, email address, and telephone number).

7.1.2. We may process certain professional details (such as your job title, occupation, academic and professional qualifications, and employment history) and your connection to the Candidate (such your relationships to, experience with, and opinions about the relevant Candidate).

7.1.3. We generally ask the Candidates to provide us with much of this information but we may supplement it with information we collect about you from publicly available sources (such as LinkedIn) or by asking you directly.

8.  SOURCE DATA

8.1.  Information Sources provide to us:

8.1.1. We may process your contact details (such as name, email address, and telephone number), professional details (such as job title, occupation, academic and professional qualifications, and employment history) and information about your connection to our Candidate (such as your relationship to, experience with, and opinions about the relevant Candidate).

8.1.2. We may collect this information directly from you and/or from publicly available sources (such as LinkedIn).

8.1.3. In some cases, we may collect the information from our Candidates.

9.  VENDOR DATA

9.1.  Information Vendors provide to us:

9.1.1. We need a small amount of information from our Vendors to ensure that things run smoothly.

9.1.2. We need contact details of relevant individuals at your organization so that we can communicate with you.

9.1.3. We also need other information such as your bank details so that we can pay for the services you provide (if this is part of the contractual arrangements between us).

10.  INDIRECT DATA COLLECTION AND COOKIES

10.1. This website automatically collects certain device information such as your IP address, unique device identifier, Cookies (as discussed below), geographic data, country, browser, device operating system, application version, language settings, and pages that have been shown to you.
